These Terms of Use ("Terms") govern your use of the TrekList.co website, app, and related services (collectively, the "Service"). By creating an account or using the Service in any way, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

2. Eligibility and account registration

  • To use TrekList, you must be able to form a binding contract under applicable law. The Service is not intended for children under 16 years of age.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You agree to provide accurate, current, and complete information when registering and to keep it up to date.
  • If we reasonably believe that you have violated these Terms, we may suspend or terminate your account (see Section 10).

3. Description of the Service

TrekList is a gear list planning tool designed for hikers and travelers. It allows you to:

  • Create and manage gear lists and categories.
  • Store item information such as weight and personal notes.
  • Generate packing checklists and printable views.
  • Create read-only public share links or embedded views.

We may add, change, or remove features from time to time to improve the Service or for other reasons.

4. Personal data and privacy

Our processing of personal data is governed by our Privacy Policy and Cookie Policy, which form part of these Terms. Please review those documents for more information about how we handle your data.

5. Acceptable use and prohibited activities

You agree to use the Service only for lawful purposes and in accordance with these Terms. In particular, you agree that you will not:

  • Use the Service in any way that violates applicable laws or regulations.
  • Upload, share, or store content that is illegal, harmful, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems.
  • Interfere with or disrupt the integrity or performance of the Service (for example, by introducing malware or using automated tools to overload the system).
  • Reverse engineer, decompile, or attempt to derive source code from the Service, except to the extent permitted by mandatory law.
  • Use the Service to send spam or unsolicited commercial communications.
  • Misrepresent your identity or affiliation with any person or entity.

We reserve the right to investigate violations and take appropriate action, including removing content, suspending or terminating accounts, and cooperating with law enforcement authorities.

6. User content and intellectual property

6.1 Your content

You retain ownership of the content you create or upload to TrekList, such as gear lists, category names, item descriptions, and notes ("User Content").

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and display your User Content as necessary to operate, improve, and provide the Service (for example, to show your lists to you, generate checklists, or generate public share views when you enable them).

You are responsible for ensuring that your User Content does not infringe the rights of others and does not violate applicable laws.

6.2 Public share links and embedded views

TrekList allows you to generate public, read-only share links and embedded views of your lists. Anyone with access to these links or embeds may be able to view the corresponding content.

You are responsible for deciding which lists to share publicly and for managing or revoking share links when you no longer wish to make a list publicly available.

6.3 Our content

The Service, including its design, layout, trademarks, logos, and underlying software, is protected by intellectual property laws and remains the property of Tall Joe Hikes or its licensors.

Except as expressly permitted by these Terms or applicable law, you may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

7. Third-party services, links, and affiliate programs

The Service may contain links to third-party websites or services, such as online retailers, affiliate programs, or external content. These third parties are not controlled by us, and we are not responsible for their content, privacy practices, or terms.

Your use of third-party websites and services is at your own risk and subject to their terms and policies.

8. Fees and payment (if applicable)

At the moment, TrekList may be offered free of charge. If we introduce paid plans or features in the future, we will provide clear information about pricing, billing, and cancellation terms.

Any paid offering will be subject to additional terms that will be presented at the time of purchase. If there is a conflict between those terms and these Terms, the more specific paid plan terms will generally prevail for the paid features.

9. Availability and changes to the Service

We aim to provide a reliable Service, but we do not guarantee that it will be available at all times or free from errors. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice, provided that we comply with applicable consumer protection laws.

10. Termination and suspension

We may suspend or terminate your access to the Service if:

  • You materially breach these Terms.
  • We are required to do so by law or by a court order.
  • We decide to discontinue the Service in whole or in part (subject to applicable law).

You may also stop using the Service at any time and may request deletion of your account and data in accordance with our Privacy Policy.

After termination, certain sections of these Terms will continue to apply, including those relating to intellectual property, disclaimers, limitations of liability, and governing law.

11. Disclaimers and limitation of liability

Important: Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law (for example, liability for intent or gross negligence, or for death or personal injury caused by our negligence where such exclusions are not permitted).

11.1 Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we do not make any warranties or representations, express or implied, about the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

TrekList is intended as a planning and organizational tool only. You are responsible for:

  • Checking the accuracy of item weights.
  • Making sure your gear is safe and suitable for your trip.
  • Making your own safety decisions in the outdoors.

We do not provide professional safety, medical, or guiding advice.

11.2 Limitation of liability

To the fullest extent permitted by law, we are not liable for any:

  • Indirect, incidental, special, or consequential losses.
  • Loss of profits, revenue, or data.
  • Losses arising from your use of third-party services or websites.

Subject to the preceding paragraph and mandatory law, our total aggregate liability arising out of or in connection with the Service and these Terms, whether in contract, tort (including negligence), or otherwise, will be limited to:

  • the amount you have paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim (if any), or
  • if you use the Service free of charge, a maximum of EUR 100.

Some jurisdictions do not allow certain disclaimers or limitations of liability. In such cases, the relevant provisions shall apply only to the extent permitted by the laws of your jurisdiction.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your violation of these Terms.
  • Your misuse of the Service.
  • Your violation of any rights of a third party.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands, without regard to its conflict of law principles, and subject to any mandatory consumer protection laws in your country of residence.

Any disputes arising out of or in connection with these Terms or the Service shall be submitted to the competent courts of the Netherlands, unless mandatory law entitles you to bring the dispute before the courts of another jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in our Service or in applicable laws.

When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email, via the Service, or by other reasonable means.

If you continue using the Service after the updated Terms have become effective, you are deemed to have accepted the changes. If you do not agree, you should stop using the Service and may request deletion of your account.
